(AP) ? It could hardly have been a riskier mission: infiltrate Auschwitz to chronicle Nazi atrocities. Witold Pilecki survived nearly three years as an inmate in the death camp, managing to smuggle out word of executions before making a daring escape. But the Polish resistance hero was crushed by the post-war communist regime ? tried on trumped-up charges and executed.

Six decades on, Poland hopes Pilecki's remains will be identified among the entangled skeletons and shattered skulls of resistance fighters being excavated from a mass grave on the edge of Warsaw's Powazki Military Cemetery. The exhumations are part of a movement in the resurgent, democratic nation to officially recognize its war-time heroes and 20th century tragedies.

"He was unique in the world," said Zofia Pilecka-Optulowicz, paying tribute to her father's 1940 decision to walk straight into a Nazi street roundup with the aim of getting inside the extermination camp. "I would like to have a place where I can light a candle for him."

More than 100 skeletons, mostly of men, have been dug up this summer. On one recent day, forensic workers and archaeologists wearing blue plastic gloves and masks were carefully scraping away at the soil and piecing together bones as if working on a jigsaw puzzle. The front of one skull had been blown away by bullets; another had apparently been bludgeoned; a skeleton showed evidence of multiple gunshot wounds.

Near the pit where the bodies were dumped under cover of night stand the well-tended tombstones of the very judges and prosecutors who sent these World War II heroes to their deaths under orders from Moscow, which was fearful that the Polish patriots might use their seasoned underground skills to turn the nation against its new pro-Soviet rulers.

"The perpetrators have not been punished and the bodies of the victims have not been found," said Krzysztof Szwagrzyk, a historian in charge of the dig. "Those times will be coming back to us until we find the bodies and bury them with due honors.

"We are doing them justice."

Pilecki's son Andrzej and dozens of other relatives of victims have been swabbed in the hope their DNA will be a match for the skeletons. Initial work is being carried out to determine age, sex, height and injuries of the victims. It will take several months to determine if Pilecki, who was killed by a bullet to the back of his head, is among them. Thousands of resistance fighters were killed across Poland; the remains of up to 400 are believed to have been dumped in the Powazki mass grave.

Pilecki was 38 when Germany invaded Poland on Sept. 1, 1939, triggering the start of World War II. He helped organize a resistance campaign during which many fellow fighters were caught and sent to Auschwitz, which in the early war years served more as a camp for Polish resistance fighters than Jews. That inspired him to hatch an audacious plan: He told other resistance commanders that he wanted to become an Auschwitz inmate to check on rumors of atrocities.

Carrying documents bearing the alias Tomasz Serafinski, the Catholic cavalry officer walked into the German SS street roundup in Warsaw in September 1940, and was put on a train transport to Auschwitz, where he was given prisoner number 4859.

He was "exceptionally courageous," said Jacek Pawlowicz, a historian with Warsaw's Institute of National Remembrance.

Pilecki is the only person known to have volunteered for Auschwitz. His terse dispatches to the outside world were slips of thin paper stitched inside clothes of inmates leaving the camp or left in nearby fields for others to collect. They included only code names for inmates who were beaten to death, executed by gunfire or gassed. As sketchy as they were, they were the first eyewitness account of the Nazi death machine at Auschwitz.

Pilecki survived hard labor, beatings, cold and typhoid fever thanks to support from a clandestine resistance network that he managed to organize inside the camp. Some of its members had access to food, others to clothes or medicines.

He plotted a revolt that was to release inmates with the help of an outside attack by resistance fighters; it was never attempted because considered too risky, Pawlowicz said.

Pilecki escaped in April 1943 when he realized that the SS might uncover his work. With two other men he ran from a night shift at a bakery that was outside the death camp's barbed wire fence.

After his escape, Pilecki wrote three detailed reports on the extermination camp.

One describes how his transport was met by yelling SS men and attacking dogs: "They told one of us to run to a post away from the road, and immediately sent a machine gun round after him. Killed him. Ten random colleagues were taken out of the group and shot, as they were walking, as 'collective responsibility' for the 'escape' that the SS-men arranged themselves."

Pilecki's heroics were for the most part in vain. Even though his accounts of gas chambers made it all the way to Poland's government-in-exile in London and to other Western capitals, few believed what they were reading.

After escaping, Pilecki rejoined Poland's Home Army resistance force and fought in the 1944 Warsaw Uprising, the city's ill-fated revolt against the Nazis. In 1947, he was arrested by the secret security of the communist regime, imposed on Poland after the war, and falsely accused of planning to assassinate dignitaries.

The Soviet plan after World War II was to subdue the Poles by crushing resistance and erasing any sense of Polish identity or history. Today, more than two decades into Poland's democracy, however, enough documentation and funds have been gathered to restore the banned past and try to find and identify the heroes' bodies.

In addition to Pilecki, the search is on for the remains of other wartime resistance heroes, including Brig. Gen. August Emil Fieldorf, a top clandestine Home Army commander who once served as emissary to Poland of the country's government-in-exile. He was accused of ordering killings of Soviet soldiers ? charges that Poland's communist authorities later admitted were fabricated ? and hanged in 1953.

Szwagrzyk is not sure if Pilecki will be found at Powazki cemetery because it is not the only such clandestine site in Warsaw or the rest of Poland.

But his place in history is gradually being restored. A street in Warsaw is now named after him, as are some schools across the country.

He found communist prison harder to endure than Auschwitz. A fellow inmate described seeing him in prison slumped, unable to raise his head because his collar bones had been broken. At his show trial, he was hiding his hands because his fingernails had been ripped out during torture.

At one court session, he told his wife Maria that the secret security torture had sapped his will to go on.

"I can live no longer," he said.

With choreographed conventions, is something lost?

WASHINGTON (AP) ? As Chris Christie's moment at the microphone neared, delegates to the Republican National Convention were atwitter at the chance to hear the New Jersey governor speak. After all, who knew what might happen? "He doesn't seem to have a filter," said David Shimkin, a delegate from New York.

But the famously freewheeling Christie did in fact have filters: He used a teleprompter, and he read from a speech that has been vetted and approved.

Americans hunger for authenticity ? or, at least, say that they do. The explosion of reality TV is testament to that desire for the unscripted moment (even if that unscripted moment is, well, scripted). So the slick choreography of the modern political convention, while understandable, also seems odd. And, some say, it's actually counterproductive to what the parties say they want to accomplish: generate passion that translates into votes.

"This regard for order, this insistence on order, it's just weird," says Richard Bensel, a professor of American politics at Cornell University.

It's that need to control the message and the messengers that led Texas Congressman Ron Paul to hold his own alternative rally Sunday in Tampa, Fla., drawing a crowd of thousands. "It's exactly what the Republican Party should have wanted ? real spirit, real emotion," Bensel says. "That enthusiasm shouldn't be offstage. It shouldn't be in an independent rally."

But it's the way things work these days. And Robert Lehrman, who was Vice President Al Gore's chief speech writer for three years, says that if he were GOP nominee Mitt Romney, he would insist on an orderly convention.

"You're trying to show a unified, strong party that represents your views," says Lehrman, author of the 2009 book "The Political Speechwriter's Companion." ''And to have those kinds of debates doesn't help the campaign."

"Used to be 30 years ago, you had platform fights, and they would come from the floor and be debated," he says. "Now, they had some platform stuff on CSPAN, where 30,000 people watch it. But 30 million people have no idea about those things."

In the 19th century, the candidates mostly avoided the conventions altogether. In 1860, Lincoln stayed home in Springfield and his supporters did the work. To do otherwise, Lehrman says, "was considered immodest."

Harry Truman was such a terrible speaker that his aides, at the 1948 Democratic convention, decided to give him a list of talking points instead of a speech. To make things worse, just as he reached the stage, a woman rushed up with a cage full of "doves of peace" ? which promptly got loose and, as one aide would later write, "did what pigeons do." The speech went on to be one of Truman's more memorable, but it's hard to forget the pigeons.

There was a time when a rousing convention speech could make history. William Jennings Bryan was a little-known former Nebraska congressman when he arrived in Chicago for the 1896 Democratic National Convention to make a speech in favor of the free-silver movement. Most newspapers covering the event listed him sixth or lower ? if at all.

"He was technically a candidate, but in the way, say, Ron Paul is. Even less than that, actually," says Bensel, author of "Passion and Preferences: William Jennings Bryan and the 1896 Democratic Convention." But after Bryan delivered his now legendary "Cross of Gold" speech, he walked away with the party's nomination ? and a place in the history books.

Sociologist and essayist John Shelton Reed understands that the Republicans don't want another "Pat Buchanan moment" ? the former presidential candidate's infamous "culture war" speech at the 1992 GOP convention in Houston.

"There is a religious war going on in this country," Buchanan thundered from the podium. "It is a cultural war, as critical to the kind of nation we shall be as the Cold War itself. For this war is for the soul of America. And in that struggle for the soul of America, Clinton and Clinton are on the other side, and George Bush is on our side."

"Everybody seemed to agree that was not helpful," Reed says. "They didn't check it in advance, I'm pretty sure."

Christie is famous for speaking bluntly and loudly. But he understands that Tampa is not the place for winging it. In an appearance on MSNBC's "Morning Joe," Christie acknowledged as much. "I don't use text almost ever," he said. "So most of the time I think about what it is I want to talk about, and then I get up there and I talk about it."

Given the venue and the time restrictions, Christie said, "they want you to work off a text, and that's fine." But he noted that former Mississippi Gov. Haley Barbour reminded him that he needed to "be Chris.'"

"If that means I stray a little off the prompter every once in a while," he said, "that's the way it goes."

Christie did not stray much, except to add emphasis or focus his audience. And while he did seem a tad less spontaneous than usual, his delivery ? "I know this simple truth and I'm not afraid to say it" ? was every bit as powerful.

It's that delicate balance ? preparation without overpackaging ? that is so difficult to strike. Rick Andrews, who teaches improv at New York's Magnet Theater, works with businesspeople trying to communicate better. The trick for politicians, he says, is to try to "appear casual, off the cuff ? when you're not."

"We would be shocked if they weren't prepared," Andrews says. "But we also don't want them to appear to be overly prepared."

Republicans, including Romney, have openly mocked President Barack Obama's use of the teleprompter. But Ann Romney, the former Massachusetts governor's wife, seemed relieved to know she would not be up on that stage alone. She told reporters Tuesday that she had "never gone off of a written text."

"I had a lot of input in this, I must say, and a lot of, um, tweaking where I felt like was getting what I really wanted to say and from my heart," she said.

Whatever butterflies she might have had going in, they had flown soon after she took the stage. She even went off script at regular intervals, channeling Oprah Winfrey after a passage about mothers, wives, sisters and daughters: "I love you women, and I hear your voices," she shouted.

Mitt Romney has a reputation for being somewhat stiff. But Lehrman is looking forward to his performance Thursday evening ? particularly given that the GOP nominee has been working with an oratory coach. "I see him being more impassioned and more natural," Lehrman says. "He's been able to fake naturalness better."

And in the process, perhaps, something valuable is lost. That's how Bensel sees it. By sculpting their conventions so carefully, he says, both political parties are missing out on the chance to make history.

"The problem is, when you script the speech, the crowd isn't involved and there's no feedback, there's no spontaneity," Bensel says. "The whole connection between the party rank and file as audience and whoever's speaking is broken. You are just an audience. You aren't a participant in the creation of a political moment."

California leaders strike public pension reform deal

LOS ANGELES (Reuters) - California Governor Jerry Brown and lawmakers have reached a deal to raise public employees' retirement ages, have them pay more into their pension accounts, and cap retirement payments in a vast overhaul of the state's pension system that he says will save $30 billion.

Union leaders panned the deal between Brown and fellow Democrats who control the legislature and hope to drum up support for his tax measure on the November ballot by showing voters they can tackle big challenges.

California faces a huge liability for funding the nation's largest public pension system, but other states and cities also have huge pension funding gaps and will be watching the state closely.

Brown did not get everything he wanted from lawmakers, such as a hybrid plan that would funnel some contributions into 401(k)-style accounts, and some of the deal's measures will not affect current employees.

But Brown said at a press event in Los Angeles that the changes would ensure the state's pension system would be sustainable.

"We have lived beyond our means," he said. "The chickens are coming home to roost and this is just one in a series of countermeasures that will be required over the next decade."

The legislature's Democratic leaders plan for the full state Senate and Assembly to vote on the changes on Friday, the last day of the legislature's session for this year.

Democrats have enough votes on their own to approve the plan, which is based on proposals made by Brown last year. The legislature's Republican minority endorsed his proposals.

The package of reforms includes provisions that will require new state and local government workers to split payments to pension accounts at least evenly with their employers.

Local governments using the state's pension fund to manage retirement accounts could impose higher payments from employees if they are unable to negotiate the 50-50 split in five years.

New employees must work two additional years to get maximum benefits after retirement. Formulas used to calculate pensions for new employees will be changed, making them less generous.

Government employers will be given more flexibility in crafting pension plans and new rules will be put in place to prevent inflated pension payments.

Additionally, savings to the state from employees paying more toward their pensions will be used to reduce its unfunded pension liability.

"Anything that reduces the state's unfunded pension obligation would be a good thing," said Steven Zimmermann, Western Region managing director at Standard & Poor's Ratings Services.

Labor groups were stunned by the deal, expected to be approved in a conference committee later on Tuesday.

"We are outraged that a Democratic governor and Democratic legislature are taking a wrecking ball to retirement security for teachers, firefighters, school employees, and police officers," said Dave Low, chairman of Californians for Retirement Security, which represents 1.5 million public employees and retirees.

Outside the state building where Brown unveiled the agreement, union activists said the deal unfairly bypassed collective bargaining rights.

"Labor did not have input on this and we are very, very concerned on what this will mean for rank and file workers," said Barbara Maynard, also with Californians for Retirement Security.

Brown has lobbied lawmakers for a pension package since last year and has said that putting changes into law is critical for helping convince voters to support his November tax measure.

If voters reject the measure, California will need to cut more spending, including more than $5 billion from popular education programs, to keep its books balanced. The measure would increase the state sales tax to 7.5 percent from 7.25 percent for 4 years and raise income taxes on Californians making more than $250,000 a year for 7 years.

"Pension reform is just a big issue for folks these days," said Larry Gerston, a political scientist at San Jose State University. "This helps build his credibility."

Voters in San Jose, California's third largest city, approved a measure in June to clamp down on pension expenses. San Jose Mayor Chuck Reed said the deal between Brown and lawmakers is significant - but urged constitutional changes so future legislature could not undo them.

Ukraine court to rule on Tymoshenko appeal on Wednesday

KIEV (Reuters) - A high court in Ukraine will rule on Wednesday on former prime minister Yulia Tymoshenko's appeal against her abuse-of-office conviction and seven-year prison sentence - a case that has soured Kiev's ties with the West.

The European Union shelved landmark deals on political association and free trade with Ukraine after a local court sent Tymoshenko to prison last October over a gas deal brokered with Russia in 2009 as prime minister.

The government of President Viktor Yanukovich, Tymoshenko's long-time political foe, says the agreement went against national interests and saddled Ukraine with an exorbitant price for vital energy supplies.

Tymoshenko, one of the leaders of the 2004 Orange Revolution protests that derailed Yanukovich's first bid for presidency, says she is the victim of a vendetta by Yanukovich, who narrowly beat her for the presidency in February 2010.

Her prosecution will be a major issue in the parliamentary election on October 28 when Yanukovich's Party of the Regions will seek to keep its control of parliament.

Tymoshenko's lawyers argued in court this month that negotiating the gas agreement with Russia had been a political act which did not amount to criminal action.

Tymoshenko, 51, has not attended the appeal trial herself, receiving treatment for back trouble in a state-run hospital since May.

"The full text of the ruling...will be announced on August 29, 2012, at 10 a.m.," the court said on its website on Monday.

Her supporters are not expecting the high court to acquit Tymoshenko and are pinning their hopes on the European Court for Human Rights (ECHR) which can start looking into the case after she has exhausted her appeals at home.

However, Tymoshenko could stay in prison even after winning an appeal in Strasbourg as local prosecutors have brought more charges against her.

In a separate trial, where hearings are set to resume on September 11, Tymoshenko is accused of embezzlement and tax evasion going back to alleged offences when she was in business in the 1990s.

Some people are just naturally good at everything, it seems.

For 10-year-old Tyler Flannelly, the signs are already there that the Myrtle Beach triathlete has joined that group.

Flannelly is the official winner of the Mammy?s Kitchen Athlete of the Week award after garnering 5,700 votes. His nomination came after winning the Fourth Annual Myrtle Beach Kids Triathlon.

Flanelly was the overall winner in the race, swimming 200 yards, cycling 10K (6.2 miles) and running 2k (1.3 miles). The full-length race was for ages 11-15. Flannelly?s birthday put him just on the other side of the age line, competing with much older kids. This is the third year in a row that Flannelly has won the overall portion,? however the previous year?s wins came in the younger division, which runs just a half course.

Flannelly is just a natural athlete, regularly competing in 5k events, along with his participation in lacrosse, football, baseball, and basketball. He?s a member of the Myrtle Beach Dune Warriors, summer league lacrosse team, his favorite sport of all. He?s also currently playing running back for a Myrtle Beach recreation league football team, the Steelers.

Triathlons seem to come easy for Flannelly though, ?I had plenty of energy after I got out of the water. When I got off the bike, I was thinking to myself, this is the last part and you have to run your hardest,? said Flannelly.

Flannelly originally saw a flyer for the Triathlon and thought ?I just wanted to do the sport. It has all the sports I like so, why don?t I try.? Running is where he excels and even competes with the Myrtle Beach Track and Field Club during their spring and summer season.

An A and B student in school, he?s very encouraging of the other competitors. His mother Jami says ?He?s a good kid; he?s got a big heart. He really enjoys cheering on the other kids and getting them to work hard. He?s very encouraging.? She went on to say, ?He?s got a competitive drive like I?ve never seen. Everything he does, he does well. He?s just determined. We took him surfing for the first time a few days ago, and he stood up on his second try.?

Flannelly was quick to note that his sister Kailey was his inspiration and that he also loves music and likes to draw.

Well rounded, and liked by others. Tyler Flannelly seems like the perfect recipient for the Mammy?s Kitchen Athlete of the Week award. One wouldn?t have to be a fortune teller to see that this young man is going to win this award multiple times, just like he has the Myrtle Beach Kids Triathlon.

Michael Atkins - Seattle Trademark Lawyer - Analyzing the ...

Following is a guest post from my former student and recent UWSL LL.M. graduate, Aman Gebru, on the evolving?theory of contributory trademark dilution, a claim he notes recently got traction in a local case.?This?post is adapted from his seminar paper entitled: ?The Claim of Contributory Dilution under the Trademark Dilution Revision Act.? In the fall, Mr. Gebru will continue his legal studies at the?University of Toronto, where he will pursue the equivalent of a Ph.D.

Praise and criticism?for claim of contributory dilution:

?[It is] the most pernicious concept ever to come out of trademark theory.? -Mark A. Lemley, The Modern Lanham Act and The Death of Common Sense.

?[S]ome form of imputed liability for dilution is no more ?pernicious? than dilution itself? -John T. Cross, Claim for Contributory and Vicarious Liability.

??While there is no authority directly on point, there would seem to be no logical reason why the doctrine of contributory infringement should not apply to a claim under the federal anti-dilution law.? -J. Thomas McCarthy, McCarthy on Trademarks.

?It would be inconsistent with the Trademark Dilution Act to prohibit a cause of action for contributory dilution.? -Hon.?Ricardo Martinez, Microsoft v. Shah, No. 10-653 (W.D. Wash. Jan. 12, 2011).

Imagine that Napple, a famous electronics producer, has succeeded in giving consumers a ?high-social-class? impression through its smart-phone and laptop products. Simply put, consumers feel classy when they purchase Napple?s products. Marketers have identified?this method of marketing is what drives the high demand for Napple?s products. MicroGoogle, Napple?s arch-rival, wants to destroy the advantages its competitor has gained through this strategy. MicroGoogle?s CEO consults her lawyers, who say if MicroGoogle uses Napple?s trademark in a confusing way?or?directly dilutes it, they would be liable. Therefore, MicroGoogle?s CEO decides that?MicroGoogle instead should use Napple?s trademarks in a way that reduces its high-class impression. The strategy works, and?a sharp decline is noticeable in Napple?s sales shortly thereafter. Within weeks, MicroGoogle decides to go for the kill shot, and?pays the influential ?Rapper?Snapper,? to use offensive slang in reference to people using Napple?s products in his music. Napple, furious about the issue,?decides to bring a suit against MicroGoogle.???

Does Napple have a valid claim for contributory dilution against MicroGoogle?

The cause of action for dilution is unique in trademark law. Traditionally, protection was limited to guard against the confusing use of?a distinctive mark, in an effort to?protect?consumers. Under?dilution principles, there is no requirement to show confusion. In dilution,?the plaintiff is saying ?I have invested so much in promoting my famous mark, and its?distinctiveness is being ?blurred,? or its wholesomeness is being ?tarnished,? by the defendant.?

Although the?dilution?has become?widely accepted, the claim of contributory dilution has had a different fate. Most?courts faced with the claim failed to give direction?as to?whether a valid claim for contributory dilution exists. While Congress had the chance to clarify the confusion when it enacted the Trademark Dilution Revision Act of 2006,?it actually?added to the confusion when it excluded the contribution to a ?fair use dilution? from liability and kept silent about the contribution to ?non-fair-use? dilution. The confusion has not been clarified for some time.

That is, until the Western District?recognized what some have called???a novel cause of action? and denied a motion to dismiss?the claim in July?2012 in Microsoft v. Shah. While earlier courts struggled with the notion that such a cause of action should be recognized, Judge Ricardo Martinez?held: ?It would be inconsistent with the Trademark Dilution Act to prohibit a cause of action for contributory dilution.???Since most of the decisions regarding the cause of action have been made by trial?courts, however, it is still not clear if?a valid claim for contributory dilution will exist on a broader scale. The issue becomes more interesting when one considers the enormous amount of investment required to create a?famous, wholesome, and highly distinctive mark. The recent debate and lobbying regarding proposed SOPA/PIPA legislation may also put pressure on the issue of contributory liability for dilution online.?

My paper (accessible?here) discusses?case law regarding contributory dilution from various circuits and analyzes the direction courts seem to be heading. I argue that even if the status of the claim is not yet clear, courts should give broader?recognition to the claim and use existing jurisprudence to provide for its elements?? similar to?the accepted cause of action for contributory?trademark infringement.

Thank you, Aman!

N.B.?Readers may remember the Shah decision from STL?s post here.

GOP Convention Lineup Will Stay Mostly the Same, Tuesday-Thursday

The more things change, the more they stay the same. Republican officials unveiled their revised schedule on Sunday evening, revealing an unchanged prime-time lineup for Tuesday through Thursday night and the seemingly seamless addition of Monday?s speakers to the rest of the schedule. But even as they appeared to finally cement a convention schedule in flux since Tropical Storm Isaac forced the cancellation of Monday?s programming, the event?s organizers acknowledged the storm?s continued and possibly devastating march could force further changes.

?We are continuing to plan for Tuesday, Wednesday, Thursday, but at the same time we?re obviously monitoring what?s going on with the weather,? said Russ Schriefer, an adviser to Mitt Romney?s campaign, in a conference call with reporters. ?But our concern has to be with people in the path? of the storm.

Schriefer did not explicitly knock down speculation the convention could be extended one day, to Friday, although he emphasized he can?t predict the storm?s path and didn?t want to answer any ?hypotheticals.?

So, in a way, the Romney campaign finds itself in the same situation it was in last week, when it was dogged by speculation Isaac would delay or even cancel the event. The difference now is instead of concern over the storm hitting Tampa, Republicans must worry about it striking New Orleans. The city was put under a hurricane warning on Sunday.

The sensitivity is obvious: Republicans don?t want to be seen as partying while a storm hits a city that only seven years ago was devastated by Hurricane Katrina. The perceived lackluster response from the Bush administration to that natural disaster helped sink the Republican president?s political standing ? memories the Romney campaign does want to conjure up.

The former Bay State governor?s most sensitive schedule change was to that of former Arkansas Gov. Mike Huckabee, who was set to speak on Monday night. The Romney campaign moved Huckabee to Wednesday night.

The 2008 presidential contender, a pastor with his own TV and radio shows, is one of the popular political figures among evangelicals, the group of voters most resistant to Romney?s candidacy during the primaries. They have rallied around Romney since the start of the general election race, but any perceived slight to Huckabee could have re-opened the old wound.

Other luminaries who had their Monday speaking slots moved include former Florida Gov. Jeb Bush, now speaking on Thursday night, and libertarian favorite Sen. Rand Paul, R-Ky., now speaking on Wednesday.

The schedule also included one other surprise addition: former House Speaker and Romney presidential primary rival Newt Gingrich and his wife, Callista, who are now slated to speak Thursday evening.

Despite the last-minute pressure to make changes,? buyer?s remorse for the selection of the convention city -- or public pining for runners-up Salt Lake City and Phoenix -- appears scarce.?

Conventioneers say a major storm would have pushed back the start of a national convention whether the host city was going to be affected or not, as Hurricane Gustav did in 2008 in St. Paul.

?If the convention were in San Diego or New York City or Atlanta or any other city, there would likely be a suspension of convention activities due to the impending landfall of the storm,? Justin Sayfie, a former top aide to Jeb Bush and publisher of a prominent Florida political site, told National Journal on Sunday.

?It?s really necessary to suspend the convention because a natural disaster supersedes pure politics, and it would not send the right message or be perceived well by anyone of some of the most powerful people in the country were focused on politics and not on preparation and response to the potential natural disaster,? Sayfie said.

The Republican National Committee awarded Tampa the convention in May 2010, after the city had been shut out of two previous convention bids. On Sunday, then-party chairman Michael Steele waved off suggestions that the party had erred under his leadership in selecting Tampa two years ago.

?I get blamed for everything apparently these days,? Steele said on MSNBC?s Up with Chris Hayes. ?I?m convenient. ? We set this in motion two years ago. Like we could forecast the weather??

Hillsborough County, home to Tampa, has voted for every successful presidential candidate since 1960 save one. In 1992, the county opted for a second term for President George H.W. Bush over Bill Clinton and Ross Perot. With a population of 1.2 million, the county at the intersection of I-4 and I-75 voted twice for President George W. Bush. Four years ago it gave Barack Obama a 7-point margin.

The removal of one of the four convention days could limit the political impact of an event Republicans believe should lift Romney in the polls. Some in the party dismissed those concerns Sunday.

Sen. John McCain, R-Ariz., appearing on NBC's Meet The Press, discounted the importance of the convention?s opening night, which the three broadcast networks had already decided not to air. But any further cancellations would be ?unfortunate,? he said. ?It?s Wednesday and Thursday night that are the big moments,? McCain said. ?I don?t think it?ll be damaging if we lose that first night. But it could be harmful if we lose more than that.?

China Mobile Needs Business Transformation Due to the Rise of Mobile Internet
front

Telecom operators in China are facing tremendous pressure as profits from services such as calls, text and voice messaging are being heavily eroded by the rising popularity of mobile internet services. China Mobile, one of the three main carriers in China, said its revenue dropped to a new low over the first half of this year. Its earnings before interests and taxes have decreased by 3 percent year-on-year. The growth of its voice and text message only increased slightly while its mobile data transmission surged by 17 percent compares to the same period last year. Revenue from its wireless internet service has replaced text messaging to become the third largest income source, amounting to 38 percent of total income in the first half of this year ?

China Mobile has set up new measures and business models such as establishing new channels, open up platforms, and create friendly user interfaces in response to the rise of mobile internet, and providing download services for digital music, e-books and payment services. The company also increased its subsidies for smartphones as the sector?s growth has contributed to its revenue from the mobile internet, which amounts to 101.6 yuan (US$15.9) average revenue per user per month, higher than the 63.81 yuan (US$9.9) of 2G mobile users. Frankly speaking, we are actually more interested in the development of China Mobile?s 4G network. Early this year, the company has unveiled their plan to widely deploy TD-LTE across the country. Chinese mobile user need a better mobile data transmission right now, since the country?s mobile internet speed is second slowest in the world. And the iPhone is currently unavailable on the influential network due to incompatibilities.

Key Pakistani Taliban figure killed in Afghanistan

KABUL, Afghanistan (AP) ? A NATO airstrike in eastern Afghanistan killed a dozen militants including a senior leader of the Taliban in Pakistan, the international military coalition said Saturday, dealing a blow to armed extremists operating on both sides of the countries' porous border.

The strike in Afghanistan's eastern Kunar province killed Mullah Dadullah, the self-proclaimed Taliban leader in Pakistan's Bajur tribal area that lies across the border, late Friday afternoon, coalition spokesman Maj. Martyn Crighton said.

Dadullah reportedly took over after Bajur's former Pakistani Taliban leader, Maulvi Faqir Mohammed, fled to Afghanistan to avoid Pakistani army operations.

He was responsible for the movement of fighters and weapons, as well as attacks against Afghan and coalition forces, a coalition statement said Saturday. It added that Dadullah's deputy, identified only as Shakir, was also killed in the strike along with 10 other militants, and that an assessment made in conjunction with Afghan security forces determined no civilians had been killed or injured.

The airstrike was in Kunar's Shigal district, which lies about 15 kilometers (about nine miles) from the Pakistani border, but Crighton would not say whether an unmanned drone or manned aircraft had launched the missiles.

A spokesman for the Pakistani Taliban, Ahsanullah Ahsan, said Dadullah was killed in a drone strike in Kunar. He said Maulana Abu Bakar has been named as the new chief of the Bajur region.

Pakistani intelligence officials said Dadullah and 19 others were killed in the attack. Initially, they said the strike was on Pakistani territory, but later they conceded it was in Afghanistan.

Militant hideouts along the Afghan-Pakistan border have been a source of tension for both governments as well as for the coalition, with each saying the others are not doing enough to expel the various pro-Taliban factions.

The Pakistani intelligence officials, who spoke on condition of anonymity because they were not authorized to brief the media, said Friday's coalition airstrike occurred after a cross-border attack by Pakistani Taliban militants who came from Afghanistan. The Pakistani intelligence officials said the militiamen and army soldiers fought the militants for hours but eventually repelled the attack.

Jahangir Azam Khattak, a local Pakistani government official, said dozens of militants attacked a Pakistani post manned by anti-Taliban militiamen in the Salarzai area of Bajur. He said six militants were killed and four tribesmen were wounded.

However, Crighton said there was no coordination between Pakistani and coalition military leaders on the airstrike.

"This was an independent operation and not associated with any others," he said.

Taliban-affiliated militants operate on both sides of the porous border, with various groups targeting both coalition forces in Afghanistan and the Pakistani military.

Pakistan has complained of cross-border attacks by militants hiding out in eastern Afghanistan and has criticized Afghan and U.S.-led coalition forces for not doing enough to stop them or expel them from Afghan territory.

The U.S. and Afghanistan, however, have long criticized Pakistan for its failure to prevent militants from carrying out attacks in the opposite direction.

A Kunar provincial government spokesman, Wasifullah Wasifi, said four wounded Pakistani citizens have been hospitalized in Kunar and will be questioned about the activities of the Taliban inside Afghan territory.

"They were exactly where this incident happened yesterday, so I am sure they were with these who were killed," Wasifi said. He added, "We are trying to find out how long these people have been here and why they were here."

Syphilis epidemic rising in the Canada and U.S. | AguiLeon Health ...

The resurgence of syphilis has risen dramatically over the past 20 years in the United States and Canada --- from 177 cases in 1993 to 1,750 cases in 2010. It is temporarily shutting down the porn industry in Southern California.

Adult Production Health & Safety Services (APHSS) sounded the alarm about "recent unsubstantiated rumors of syphilis among adult performers." The usual annual testing for syphilis is in September, but because of the alarm the agency opened up their semi-annual syphilis testing immediately.

Other sexually transmitted diseases, such as gonorrhea and chlamydia, are also on the rise. According to Huffington Post, "Syphilis infection rates jumped by 18 percent from 2010 to 2011, and there was also a five percent increase in chlamydia and 1.5 percent increase in gonorrhea cases." And truthfully, the syphilis outbreak cluster among California porn performs is not surprising because of their business. But sexually transmitted diseases are spreading on a worldwide basis --- with Canada and the United States no exceptions.

APHSS has since called for a temporary moratorium on adult film production until all performers get tested for syphilis, and the non-profit AIDS Healthcare Foundation is also expected to hold a news conference Monday morning in response to the possible outbreak.

"I think it's just a general indicator of what's happening in terms of sexual activity," said Dr. Howard Njoo of the Public Health Agency of Canada, director general of PHAC's Centre for Communicable Diseases and Infection Control. The majority of syphilis cases are among men, accounting for 90.5 percent of all reported cases in 2010. But according to Njoo, the dynamics of the disease are different from other STDs. Gonorrhea and chlamydia are attacking the younger people while syphilis is attacking the older ones. People who are age 30 and older are accounting for approximately 73 per cent of all the reported syphilis cases in 2010. Huffington Post reports that, "Syphilis is a bacterial STD that initially manifests itself in sores or sometimes presents no symptoms. If the infection isn't treated immediately, people who have syphilis can go on to suffer rashes and lesions, hair loss and flu-like symptoms like muscle aches, fevers, sore throats and fatigue. Without treatment, syphilis could last for years and go on to damage internal organs and cause stillbirths. If caught early, the infection is easily treated with antibiotics such as penicillin."

Franchisor Responsibilities You Need to Know | Don Monteith Blog

My business partner and I owned 2 franchised businesses during our 25 years in business together plus 1 each prior to our joint venture. ?Normally, it doesn?t take that many screw ups to learn more than you want to know as an entrepreneur.

Actually, 2 of our franchises were complimentary to our main staffing business [not a franchise]. ?Originally, my franchise was in the staffing business. ?Unfortunately, the franchisor didn?t make it and had to file for bankruptcy protection from his creditors.

I mention this to you because Franchisors do go out of business and can leave you hanging on by yourself. ?Whatever franchise fees you pay, usually $20K or more, office leases, equipment leases are all your responsibility and without recourse with the franchisor.

Truth is?. our Franchisor was a fine person, Christian business executive, with a history of excellent business success. ?He was a good family man but short on building the necessary systems needed for long-term success as a Franchisor.

Even this early experience with franchising turned out to be the ?stepping stone? to my long-term future of 32 years in the staffing business. ?Following the demise of my 1st Franchisor, I was offered the opportunity to join a National Staffing Firm with business connections which proved to be a good decision for my family.

We believe there?s a reason for everything that happens. ?It helps to believe and KNOW that GOD has a life plan for us. ?Nothing is outside of HIS will, concern and knowledge. ?That simply means never give up but keep on keeping on. ? Sometimes it seems that we?re either coming out of a crisis or about to enter a new one year after year.

Fortunately, as much as we dislike rules and regulations, the Franchisors of today have to ?jump through? a number of ?hoops? to prove viability and a substantial business history. ?Any new Franchisor has to invest BIG $$ setting up a franchise offering and covering the legal requirements before he/she can begin.

Regardless of how appealing the franchise offering might be, your own due diligence is an imperative first step. ?Your own protection from making a wrong choice in the beginning and then to confirm that your decision is on the right track.

Franchisor responsibilities are long-term. ?Your original fee as well as continuing fees you?re required to pay the franchisor are NOT without a fair expectation. ?You are entitled to exceptional leadership, guidance and continuing help from the Franchisor to grow your business, add new products/services to benefit your customers.

Obviously, a careful reading of your contract with the Franchisor is more likely protective of them Vs you and yours. ?It?s imperative that your own legal counsel makes sure you are fairly dealt with in any agreements you are expected to sign with the Franchisor.

Our Franchising experiences have been both positive as well as negative. ?The main reason we share our personal history and caution today is to make sure it?s a RIGHT decision for you and your family.

Problem Set 1 Helpful Hints | Business Risk Management

Here are some homework hints for problem set 1. The first two problems involve straightforward applications of the ?Calculating Derivatives? rules listed on page 22 of the Mathematics Tutorial.? In the third problem, you need to compute partial derivatives.? The logic for partial derivatives is laid out on page 25 of the Mathematics Tutorial.? Basically, when you partially differentiate a function, you are studying how the function changes when one variable changes, holding everything else constant.? Finally, in the?fourth problem, the objective is to determine how big a hospital must be so that the cost per patient-day is minimized. We are not interested in minimizing total cost; if this were the case, there would be no hospital because marginal costs are positive, which implies that total cost is positively related to the number of patient-days. The cost equation C = 4,700,000 + 0.00013X^2 tells you the total cost as a function of the number of patient-days. This is why you are asked in part ?a? to derive a formula for the relationship between cost per patient-day and the number of patient days. Once you have that equation, then that is what you minimize, and you?ll be able to answer the question concerning optimal hospital size.

Zumba beats kickboxing, aerobics and Pilates for burning calories ...

Zumba burns more calories per minute than power yoga, cardio kickboxing, step aerobics and even advanced Pilates group classes, a study by the department of exercise and sport science at the University of Wisconsin-La Crosse found.

Zumba classes are an efficient and effective way to lose weight due to the high number of calories burned and cardiovascular intensity, the researchers found.

The study was commissioned by the American Council on Exercise and sought to determine the average exercise intensity and energy expenditure of participants in a typical Zumba class.

The group dance-fitness program, which reports 12 million class participants in 110,000 locations across 125 countries, was identified as one of the most popular workout programs in ACE?s 2012 Fitness Trends to Watch.

Exercise physiologists began the study using a test group of 19 healthy females ranging in age from 18 to 22, all of whom had prior experience in a Zumba class. To establish a baseline of fitness, study subjects each performed a treadmill test to measure their heart rate and oxygen consumption. They then completed a single Zumba class, all taught by the same instructor, while wearing a heart-rate monitor.

All participants reached a heart rate maximum of 80 percent ? an average of 154 beats per minute ? which is well within industry guidelines suggested to improve cardiovascular fitness. Class participants also burned an average of 9.5 calories per minute.

That?s more calories per minute than power yoga, cardio kickboxing, step aerobics and even advanced Pilates group classes, which were all previously tested by University of Wisconsin La-Crosse researchers.

?Just like the participants, we were surprised at how effective Zumba is in terms of its calorie-burning potential,? said ACE Chief Science Officer Dr. Cedric Bryant. ?Zumba has built an entire culture around having fun and engaging participants in this party-like atmosphere, but until now, little research has been conducted to test its effectiveness.?

Aside from its calorie-burning potential, Bryant said, Zumba is such a fun and engaging activity that many participants don?t even realize they?re expending a high amount of energy.

?The number one reason people give for not engaging in physical activity on a regular basis is the perceived lack of time,? Bryant said. ?I would argue that we find time to do things that we deem fun and engaging.?

?Our study concludes that Zumba classes can be a high-intensity cardiovascular workout for many, but we also want to note the importance of instructor expertise to ensure maximum safety for participants,? Bryant said.

American Council on Exercise is the world?s largest nonprofit fitness certification organization dedicated to providing education that helps individuals live their most fit lives.
